Please read these Terms before using an activity or purchasing the 52 Weekends Pack. The safety, assumption-of-risk, and release provisions below affect legal rights.
Agreement and scope
These Terms apply to smallhoursclub.com and the activity ideas, instructions, downloads, illustrations, and other materials published under the Small Hours Club brand (collectively, the “Materials”). “SHC” means Small Hours Club and its owners, members, managers, officers, employees, contractors, agents, successors, and assigns. By accessing or using the Materials, and by checking the acceptance box before purchase, you agree to these Terms. If you do not agree, do not use the Materials or participate in an activity.
Important Safety Notice; adult use and supervision
The Materials are intended for adults age 18 or older to select and supervise activities for children. SHC is not present, does not inspect the materials or locations used, and does not supervise or control participation. The Materials provide general activity information and are not a substitute for professional medical, childcare, food-safety, outdoor-safety, educational, or other expert advice or training. Age ranges are general planning suggestions, not safety ratings or guarantees of suitability.
Before allowing a minor to participate, an adult must read the entire activity and all activity-specific safety notes. The supervising adult is responsible for determining whether each activity, material, tool, food, location, and condition is appropriate for each participant based on age, developmental level, abilities, medical conditions, allergies, experience, and current circumstances. Adults must inspect the setting and materials, follow applicable laws, posted rules, product warnings, and manufacturer instructions, use appropriate protective equipment, and provide continuous, activity-appropriate supervision. Stop an activity immediately if conditions become unsafe.
Acknowledgment of risks
Participation is voluntary. Activities may involve risks of minor or serious bodily injury, illness, permanent disability, death, property damage, or other loss. Depending on the activity, risks may include choking or ingestion of small objects; cuts, punctures, splinters, burns, poisoning, allergic reactions, foodborne illness, physical exertion, collisions, falls, drowning, traffic, weather or temperature exposure, plants, animals, insects, tools, material or equipment failure, and acts or omissions of participants or third parties. This is not a complete list, and some risks may be unknown or unforeseeable.
Assumption of risk
To the fullest extent permitted by applicable law, you knowingly and voluntarily assume, for yourself and for each minor participant for whom you are legally authorized to act, the inherent and other risks arising from or related to the selection or use of the Materials and participation in an activity.
Release of ordinary-negligence claims
To the fullest extent permitted by applicable law, you, for yourself and for each minor participant for whom you are legally authorized to act, release and waive claims against SHC arising from or related to the Materials or participation in an activity. This release includes claims for injury, illness, death, loss, or property damage caused in whole or in part by the ordinary negligence of SHC, including alleged negligence in selecting, preparing, describing, illustrating, or warning about an activity or material.
Rights not waived
Nothing in these Terms releases or limits liability for gross negligence; reckless, willful, or wanton conduct; fraud; strict products liability or violations of statutory or regulatory duties where such claims cannot lawfully be released; or any other liability or right that applicable law does not permit to be waived.
State-specific and mandatory rights
These Terms are intended for use throughout the United States, but legal rules differ by state and jurisdiction. Every assumption of risk, release, disclaimer, warranty exclusion, damage exclusion, and liability limit in these Terms applies only to the fullest extent permitted by the law that governs the particular claim. If your jurisdiction does not allow a provision to apply as written, that provision will apply only to the minimum extent needed to make it lawful and enforceable. Nothing in these Terms asks you to waive a nonwaivable consumer right or a minor's claim where applicable law does not permit an adult to waive that claim.
Authority concerning minors
If a participant is under 18, the safety, assumption-of-risk, and release provisions must be reviewed and accepted by the participant’s parent, legal guardian, or another adult legally authorized to act for the participant. A caregiver who lacks that authority may not waive a child’s legal claims and must obtain acceptance from an authorized adult before the child participates.
No warranties
To the fullest extent permitted by law, the Materials are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or that an activity will be safe or suitable in every circumstance. Nothing in this section excludes a warranty that applicable law does not permit to be excluded.
Limitation of liability
In addition to the release above and to the fullest extent permitted by law, SHC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, revenue, or opportunity; or the acts or omissions of participants or third parties. For claims not governed by the release and not involving liability that cannot lawfully be limited, SHC’s total liability will not exceed the amount you paid SHC for the applicable Materials.
Purchases, delivery, and refunds
Lemon Squeezy acts as merchant of record for purchases and processes payment, applicable taxes, delivery, refunds, and chargebacks. Because the product is a digital download, sales are generally final once the file is delivered, except where required by law or when the delivered file is defective. Submit order, delivery, or refund requests through the support channel in your checkout or receipt, or email support@smallhoursclub.com with the order number. Lemon Squeezy may issue refunds when required by law or under its applicable policies.
Household license and intellectual property
SHC owns or licenses the Materials. A purchased printable grants the purchaser a limited, revocable, non-exclusive, non-transferable license to download and print the current edition for personal use within one household. It may not be resold, posted publicly, shared outside that household, distributed to a school, club, business, or other group, altered for redistribution, or used as the basis of another commercial product without written permission.
Third-party products, places, and information
References to tools, foods, public places, websites, manufacturers, or other third parties are provided for convenience and are not endorsements or guarantees. Follow the third party’s current warnings and instructions. SHC does not control third-party products, locations, services, rules, or content.
Governing law and venue
Except to the extent the mandatory law of your home jurisdiction applies, these Terms are governed by Colorado law, without regard to conflict-of-laws principles. To the extent a dispute may lawfully be restricted to a forum, the exclusive venue will be the state or federal courts serving Larimer County, Colorado. A mandatory consumer-protection law, small-claims rule, or other nonwaivable right in your home jurisdiction may provide additional rights or require a different forum, and that law or rule will control to that extent.
Severability; no waiver
If any provision is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
Changes to these Terms
SHC may update these Terms prospectively by posting a new dated version. The version affirmatively accepted with an order governs that purchase and the purchaser’s use of that edition, except where a later change is required by law.
